Commentary by Attorney Michael Grossman
A concern I don’t often see people discuss is when only one person involved in an accident is seriously injured. It would surprise folks how often authorities base their reports on witness testimony and statements from the people involved in the crash. But if the victim is seriously injured and unable to speak with authorities, they may only tell one side of the story.
This is another reason why clear evidence is so important, and that’s why independent accident reconstructionists are generally more reliable. Details like statements from people at the scene are just one of many pieces in the puzzle. Things like vehicle data, cell phone data, road design, road conditions, vehicle defects, speed limits, and other surrounding conditions are all taken into account to tell the whole story. Maybe authorities have taken those steps here, but that remains to be seen.
