Commentary by Attorney Michael Grossman

When people hear about accidents like this one, it’s easy for them to assume they are a result of simple driver error. However, in my experience, accidents involving multiple large trucks often require thorough investigations to understand all contributing factors.

Firstly, the involvement of both an 18-wheeler and a dump truck in this crash adds layers of complexity. These vehicles are significantly larger and heavier than standard passenger cars, making their handling and stopping distances considerably different. Any investigation needs to consider whether the drivers of these trucks were adhering to safe driving practices and whether the vehicles themselves were in good working order.

Additionally, the fact that both the dump truck and the pickup truck overturned raises questions about the dynamics of the crash. Overturns in large vehicles can be caused by a number of factors, including sudden evasive maneuvers, mechanical failures, or even improper loading. Investigators will need to look at whether the cargo was secured properly in both trucks and whether any sudden shifts in weight contributed to the vehicles losing stability.

The role of the trucking companies involved is also crucial. Were the companies ensuring that their drivers were properly trained and following all safety protocols? Companies have a responsibility to maintain their fleets in good condition and to monitor their drivers for compliance with safety regulations. If there were lapses in maintenance or in monitoring driver behavior, the companies could share in the responsibility for the crash.

In multi-vehicle accidents involving commercial trucks, driver fatigue and distraction are always potential factors. Were the truck drivers following federal regulations regarding rest periods and maximum driving hours? Investigating logbooks and electronic driving records can provide vital insights into whether fatigue played a role.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
