Commentary by Attorney Michael Grossman
Whenever it comes to motorcycle accidents, there’s always an inherent concern that authorities may have jumped to conclusions. This is because a lot of people are negatively biased against motorcyclists, and that can lead them to overlook important possible factors.
A thorough accident reconstruction should go beyond surface factors like speeding or distracted driving. What were road conditions like? Was visibility clear? Did someone fail to yield? Was a driver unlawfully over-served by a bar? Did vehicle defects play a role? Are there nearby security cameras that caught the incident on video?
Sometimes, authorities show that they’ve looked into these kinds of possible factors, and they took the investigations seriously. Other times, they come up short and show that their preconceived notions stood in the way of letting the evidence tell the story. By being proactive, victims and families can find out if they’d be better off having a second set of eyes look things over to see if something important slipped through the cracks.
