Commentary by Attorney Michael Grossman
Regardless of what happened here, I get a lot of questions from people who were passengers involved in a car crash. People generally just think in terms of drivers, but the law is pretty straight-forward for passengers.
Put simply, unless they somehow did something to contribute to the accident (which is incredibly unlikely), there’s someone likely responsible for what happened to them. Whether that’s another driver, their own driver, or some other outside party (a defective part manufacturer, for example).
That’s why it’s important passengers involved in serious accidents take the time to ensure evidence is collected and preserved for whatever possible avenues lie ahead for them.
