Commentary by Attorney Michael Grossman

Current information suggests authorities were looking into alcohol as a possible factor in the accident. If alcohol was involved, my hope is authorities didn’t limit their efforts to the accident scene. They often have a narrow scope in their investigations, but alcohol related accidents can involve an outside party, such as a bar or restaurant, who needs to be held accountable. Allow me to explain.

In short, it’s illegal in Texas for an alcohol provider to over-serve someone who is obviously intoxicated. If they do so, the establishment can be responsible for that person harming themselves or others due to their intoxication. Whether that’s through criminal investigations, fines, or liability for the resulting accident, it’s important those establishments face appropriate consequences for their actions. Otherwise, it lets a wrongdoer off the hook for their role in a deadly accident, and they’d likely continue the negligent behavior until it harmed someone else. Maybe evidence will show that all doesn’t apply here, but it’s important to consider the possibility so the victim’s loved ones know they’re getting the whole story.
