Commentary by Attorney Michael Grossman
When it comes to pedestrian accidents, things aren’t always as simple as people think. Investigations need to include more than just who had the right-of-way (important as that is). Is this a well-lit area? Was there some kind of emergency? Was the victim on the shoulder? Were they near a clearly visible disabled vehicle? Was the driver distracted? Was alcohol a factor in the accident? Likely or not, a victim’s loved ones deserve to know all possible factors have been considered. Whether or not authorities are doing that here remains to be seen.
