Commentary by Attorney Michael Grossman

A serious accident will often bring up at least some alleged violations, so it’s not a surprise to see those allegations here. It would be a surprise, though, if those allegations really told the whole story. The reality is that Texas has the most complex work accident laws of any other state in the country. Despite what many think, there is not always an automatic process for holding wrongdoers accountable, getting families answers, and seeing that those affected by the accident get the benefits they deserve.

Instead, that all is often up to independent investigations and steps from the victims and families themselves to pursue a proper resolution. OSHA might cover their own priorities, but their actions alone can leave families with just as many unanswered questions as they had on day one. Hopefully action was taken here to ensure those involved in the accident knew what path forward was best for them. It’s rare for that path to show itself.
