Commentary by Attorney Michael Grossman
It’s not unusual for an OSHA summary to release so few details. People might think there would be more information behind the scenes for the victim’s family at least. However, that’s often not true. I’ve worked with countless families who lost a loved one on the job, and they can be left in the dark for weeks, months, or even longer. Why is that?
At the end of the day, OSHA has a job to do, and that’s where their focus is. Their efforts might align somewhat with the needs of a worker’s family, but navigating the maze of Texas work fatality law is more often a burden authorities leave to the families alone. That’s why many end up seeking out independent professionals who can help fill in whatever blanks authorities leave behind after they’ve moved on to other work.
So regardless of what happened here, my hope is that efforts were made beyond simply having OSHA do a standard accident investigation. There could always be more to the story a family needs to hear.
