El Paso, TX — December 8, 2023, Mario Aldama was killed as the result of a work accident at around 7:30 a.m. along Achim Drive.

The Occupational Safety and Health Administration released preliminary statements that the incident happened in the 14500 block of Achim Drive, off Darrington Road.

According to officials, 53-year-old Mario Aldama was on a scaffold while doing masonry work. Somehow, Aldama fell from the scaffolding, resulting in injuries that proved fatal. There was no mention of anyone else being hurt. While the cause of the accident isn’t clear right now, the OSHA statements showed two alleged citations labeled “Serious.” No further information is available.

While OSHA did not confirm other details publicly, I know from experience that a fatal work accident like this is bound to present unique challenges. That’s due simply to the fact that Texas work fatality law is the most complex of any other state’s work fatality laws. Unlike other states, employers are not required to subscribe to the workers’ comp system, meaning a family can find themselves at the mercy of an employer doing everything in their power to ensure they’re not responsible for getting the family the help they deserve. Whatever happened here, navigating such a complex legal maze can prove challenging without the right allies and tools available to overcome any potential hurdles.
