Commentary by Attorney Michael Grossman
People tend to just overlook train accidents because they assume they’re all open-and-shut. However, not only does any fatal accident deserve close scrutiny, but also this accident involving a work vehicle can create significant challenges for the victim’s loved ones.
Simply put, Texas has the most complex work fatality laws of any other state in the country. Despite what many think, there isn’t always an automatic process for them to receive benefits or otherwise get a fair resolution. Even OSHA finds violations and recommends fines, that alone might just scratch the surface of evidence that needs to be brought to light and paths that need to be explored to see there is appropriate accountability for the events leading to the worker’s death.
So while folks may be quick to assume there are systems in place to automatically take care of an accident like this, there could be serious challenges that need a lot more than just an OSHA investigation. It remains to be seen if the family affected by this accident ever got the answers they deserved.
