How Did This Accident Occur?

Finding out for sure, though, might require more than just efforts from OSHA. Let me explain why.

I’ve been a part of countless investigations into work fatalities over more than 30 years. The reality is OSHA investigations alone rarely tell the whole story. They tend to focus on their own priorities, which are rather narrow, since they focus on looking for code violations.

Meanwhile, families are left to navigate the most complex work fatality laws in the whole country, as Texas does not require employers to automatically provide benefits to workers or families after an accident. This can leave families in a place where they have to advocate for their own solutions. That can present a significant hurdle if there isn’t anyone focusing on their needs.

All said and done, it could be that all steps are being taken here to focus both on addressing an employer’s alleged shortcomings as well as getting a family the answers and the outcome they deserve. In my experience, though, that’s not something that should ever be taken for granted. It’s more often that families have to take steps themselves to ensure there are professionals looking into these avenues and giving the accident the attention it deserves.
