Killeen, TX — August 6, 2024, Luis Grimaldo was killed as the result of a work accident that happened at 12:30 p.m. along Phoenix Drive.

The Occupational Safety and Health Administration released initial details about the accident, which reportedly happened in an area near I-14 and WS Young Drive.

The OSHA investigation summary says that 37-year-old Luis Grimaldo was delivering packages at the time. According to the report, Luis Grimaldo reportedly feeling ill before falling unconscious, ultimately dying. Investigators said the death was “possibly related to heat-related illness.”

The OSHA statement listed 5 alleged violation citations—two were “serious” while two others were labeled “repeat.” No further information has been confirmed.

If the allegations from OSHA prove to be true, people might think that the process from there on out will be open-and-shut. The reality is that OSHA investigations, even when they find huge problems and result in serious penalties, are usually just the tip of the iceberg.

Simply put, Texas work fatality law is more complex than in any other state in the country. Despite what many think, there isn’t always a guaranteed process for getting a worker’s family the benefits they need or for them to see accountability for what happened to their loved one. OSHA may ultimately issue fines or other penalties, but many families find that those administrative solutions don’t rise to the seriousness of the events that led to the death of their loved one. That concern is more than reasonable, and it should never be ignored.

For that reason, I’ve told countless families over the years the same thing: Trust your instincts. If a family feels that officials are taking the matter seriously, that they’ve explored all of their options, and they feel justice is being served, it’s likely their situation is in the best hands possible. However, if families feel that authorities are leaving them in the dark, and they feel that there haven’t been appropriate consequences for what happened to their loved one, it may be worth exploring new avenues and finding out if there are other options on the table.
