Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that those affected deserve clear answers about what happened. That may seem simple, but in my experience, single-vehicle crashes are often more complicated than they appear. To fully understand what led to this incident, three critical questions must be asked.

First, did authorities conduct a thorough investigation? When a vehicle leaves the roadway for an unknown reason, investigators should consider all possible contributing factors. Was the driver avoiding another vehicle or an obstacle in the road? Were road conditions — such as poor lighting, uneven pavement or debris — a factor? Did authorities check for potential medical emergencies that could have impaired the driver’s ability to maintain control? Without a full reconstruction of the crash, important details could be missed.

Second, has anyone considered whether a vehicle defect contributed to the crash? The Lexus GS350 is a well-regarded vehicle, but no car is immune to mechanical failure. If there was an issue with the brakes, steering system or even sudden unintended acceleration, it could explain why the vehicle left the roadway. Tire blowouts or suspension failures could have also played a role. Unfortunately, unless someone specifically looks into these possibilities, defect-related crashes often go unrecognized. The key is ensuring the vehicle is preserved for forensic examination before it’s discarded or repaired.

Finally, has all available electronic data been collected? Most modern vehicles, including the Lexus GS350, are equipped with a black box that stores critical crash data. This information can reveal speed, braking and steering input leading up to the crash. Additionally, nearby surveillance cameras or traffic footage could provide further insight into how the incident unfolded. And in any investigation, reviewing cell phone records is essential to ruling out distraction as a possible factor.

At the end of the day, a person lost their life, and the least that can be done is to ensure a full and fair investigation that leaves no stone unturned. The only way to truly understand what happened — and to provide the victim’s loved ones with real answers — is by asking the right questions and ensuring that every possible piece of evidence is examined.
