Commentary by Attorney Michael Grossman

I can’t help but be concerned about this accident and how often I see people write off workplace fatalities. A lot of folks overlook them because they figure there’s just an automatic process for taking care of everything. However, certain things could make things more challenging.

For one, was the truck driver involved here a co-worker or from a separate company? While someone being killed on job could involve work fatality laws, an employee making a mistake and harming someone from a different company may be responsible for the accident beyond the typical confines of work accident laws. For example, an 18-wheeler striking a security guard in the parking lot of a grocery store they’re making a delivery to might be responsible for the security guard’s injuries as if the victim was any other ordinary person.

That’s just one example, but it goes to show that work accidents need to be taken as seriously as any other serious accident. There’s a family out there that needs answers, and there isn’t always an automatic process in place to get them the resolution they deserve. It may take more direct action to get them clear answers and ensure they’re exploring the proper avenues.
