Commentary by Attorney Michael Grossman
While no further information is available right now, my concern in these situations is always if authorities are really being thorough enough in their investigations. Rear-end collisions tend to involve a few common factors, so it can be all too easy for investigators to jump to conclusions and miss something important. A more thorough accident reconstruction should be able to consider even unlikely possible factors.
Did the victim’s brakes go out? Was there an issue with the roadway? Did the tractor-trailer’s taillights work properly? Was the construction zone in this area placed in such a way it unnecessarily put drivers at risk? If authorities don’t answer these questions, they could easily miss something that a victim’s loved ones would need to know. Maybe authorities here have been thorough in that regard, but it’s the sort of thing I learned never to take for granted.
