Authorities said a Big Sandy man was walking in the road when he was struck by a northbound BMW near the junction with F.M. 852.
The pedestrian, 36-year-old Kenneth McCoy, was pronounced dead at the scene of the crash, according to authorities.
The BMW driver, who was not injured, was charged with intoxication manslaughter with a vehicle, authorities said.
Authorities have not released any additional information about the Upshur County crash at this time.
How Did This Accident Occur?
Authorities likely will investigate this crash like any other fatal accident, but I hope they will dig deeper if blood tests confirm the BMW driver was intoxicated at the time.
Under Texas law, alcohol providers like bars or restaurants can share responsibility caused in accidents like this if the driver was served while obviously intoxicated.
I don’t know if that is what happened here, but the pedestrian’s family deserves to know everyone who may have played a role in this accident.
