Commentary by Attorney Michael Grossman

I certainly don’t know more about what happened here than what’s in the news. What I know from experience, though, is that Texas work fatality law is the most complex of any other state in the country. Families affected by work accidents like this sometimes assume there is an automatic process to resolve everything. However, due to the fact employers are not required to subscribe to the workers’ comp system, that’s not always true. As such, families can be caught off guard when they assume they’re going to be treated fairly, but keeping the scales balanced often requires tools, experienced allies, and careful legal strategizing. With those safeguards in place, the legal maze that is Texas work fatality law is one that can be successfully navigated.
