Commentary by Attorney Michael Grossman
Something that often surprises people to learn about my work is that a significant part of it is anticipating where authorities might come up short following a serious accident. What does that mean?
I’ve been doing this for over 30 years now, and I get a lot of calls from people who are dissatisfied with the answers (or lack thereof) they get from authorities. Single-vehicle wrecks like the one described here are just about one of the most common kinds of accidents I get those calls about. Frankly, they’re not a high priority for most departments, so officers tend to be pressured to move on quickly. That’s when hasty assumptions and “gut feelings” start to replace facts.
Unfortunately, crashes involving younger drivers are another common kind of accident where people are quick to jump to conclusions. It is a statistical reality that younger drivers are more likely to make mistakes. But that’s no excuse for just ignoring possible factors the victim may not have had control over. Combine with that the inherent challenge of a single-vehicle wreck, and there is far too much room for speculation.
Now, maybe authorities have been thorough here, but I always talk about the importance of independent investigators and how they can fill in the gaps that might otherwise let important information slip through the cracks. Perhaps those efforts here would only confirm information authorities have already addressed. That said, experience makes me hesitate to put full faith in any statements on a serious crash that doesn’t ensure those precautions are in place.
