Commentary by Attorney Michael Grossman
There needs to be a careful accounting of how exactly this collision happened and why the truck reportedly left its lane. Was the truck driver trying to avoid something in the road? Were they distracted? Had the driver been behind the wheel for a long time? Are they a new driver, or one with a history of making mistakes behind the wheel?
Here’s why these questions matter. People might see the initial reports say the truck left its lane and hit the victim, and they’ll just consider this whole thing to be open-and-shut. In my experience, though, the reasons for an accident tend to start before the driver ever got behind the wheel. That means the accountability needs to extend beyond the crash, scene as well.
