Crashes allegedly involving alcohol can be a lot more complex than folks realize. Even if authorities recommend charges against the driver, that may not be the end of the story. There could be a negligent alcohol provider who can be held accountable, as well.

Put simply, bars, restaurants, and other alcohol providers in Texas who serve someone that’s obviously intoxicated are serving them unlawfully. If an establishment over-serves someone, and it leads to them harming themselves or others, the alcohol provider can be responsible for that harm.

Too often, though, authorities overlook this. I’ve handled hundreds of cases against negligent alcohol providers, and I’ve simply lost count of how many times authorities simply moved on after an initial investigation at the crash scene. To get the full story, though, there has to be consideration for what went on behind the scenes before the crash. Not only do victims and families deserve to see accountability for the wrongdoers who harmed them, but also the community deserves to know any dangerous establishments over-serving people will be set straight.
