Commentary by Attorney Michael Grossman
People generally just assume that OSHA gets all the answers and handles work accidents from beginning to end all themselves. The reality is OSHA has their own priorities, and getting and answers and solutions for a worker’s loved ones are generally incidental to those priorities.
I’ve been handling Texas fatal work accident cases for more than 30 years now. I’ve rarely seen OSHA help a family navigate Texas work fatality law, which is more complex than any other state’s laws. That usually requires independent steps from experienced professionals and investigators who can put the needs of the family first and foremost.
It’s possible more steps have been taken behind the scenes here to ensure there’s a clear path forward for this man’s family. That’s just not something I’d ever take for granted.
