Joshua McNabb Injured in Motorcycle Accident in Lavaca County, TX

Investigators said that 35-year-old Joshua McNabb was the driver of a Yamaha motorcycle which was going westbound along F.M. 532. At a curve, it appears the motorcycle somehow crossed the eastbound lane, left the roadway, and crashed along a fence line. Due to this, McNabb had serious injuries, authorities said. It appears no one else was involved in the wreck. The cause of the crash can’t be confirmed right now.

Commentary by Attorney Michael Grossman

I talk about single-vehicle wrecks a lot on this blog, reminding folks to always consider even relatively uncommon factors. Mechanical defects, road design flaws, medical conditions, hit-and-runs, tire failure—common or not, the evidence needs to speak for itself. Folks are generally open minded to that. But once they hear the driver was a motorcyclist, all of that benefit of the doubt goes out the window.

Simply put, most people automatically assume all motorcyclists are reckless daredevils. I know from working with motorcyclists and their families that most are safe drivers—often safer than the average motorist. Now, do they make mistakes? Of course, just like any driver. But if authorities also happen to share this unfair preconception of motorcyclists, they could miss something important. My hope is they were thorough in their investigations and didn’t let any kind of bias stand in the way of the facts. Right now, though, there just isn’t enough public information to know one way or the other.
