Commentary by Attorney Michael Grossman

People might see alleged violations here and assume everything is open-and-shut from there. However, that’s likely not true. Texas has the most complex work fatality laws in the country, and families generally need a lot more than just an OSHA report to get a proper resolution.

To sum up a lot of legalese, there isn’t always a guaranteed path to get a worker’s loved ones the benefits they need after an accident. It’s up to employers if they want to subscribe to the workers’ comp system or work things out themselves. The latter choice rarely leads to them prioritizing the needs of a family above their own. That means families who lose a loved one to a work accident may need professionals of their own keeping the scales balanced.

So while OSHA has made concerning statements surrounding this particular accident, that’s likely just the tip of the iceberg. Unless steps were taken to specifically help the family get the answers they needed, there could be more to this story yet to get the proper attention.
