Commentary by Attorney Michael Grossman
Even when OSHA alleges that they found violations following a work accident, that doesn’t make things open-and-shut like folks may think. A lot of the time, there needs to be independent investigations so the victim’s family has everything they need going forward. Texas has the most complex work fatality laws of any other state in the country. There isn’t always some automatic process for getting them benefits, like a lot of people assume. More often, it’s up to them to have the evidence, legal strategy, and experienced allies needed to navigate that legal maze. If there was still more to this story beyond what OSHA has worked on, it wouldn’t at all be unusual.
