Commentary by Attorney Michael Grossman

There are important questions not being answered here. How much space was there between the two vehicles when the construction vehicle entered the SUV’s path? Were there flaggers waving down traffic? Was there a worker with a stop sign in the road? Was the construction vehicle driver being impatient or inattentive? Did this happen due to unsafe business practices, such as a lack of training or supervision? Was this crew under unreasonable time constraints, leading to hasty decisions? Were there other extenuating circumstances neither driver could account for?

These might seem like obvious questions, but they’re the sorts of details I’ve seen authorities overlook time and time again. Maybe authorities here are being more thorough, but it’s not prudent to take that for granted. At the end of the day, there’s a family out there that deserves answers. Simply looking at road conditions or cell phone records (important as those are) may only tell part of the larger story. There needs to be as much evidence as possible telling the story to help ensure this sort of thing doesn’t happen again.
