Commentary by Attorney Michael Grossman
As open-and-shut as it may seem that this crash reportedly involved someone running a red light, it’s important investigations determine why that happened. This early in the morning, my immediate concern is possible drunk driving.
Folks might be inclined to think it wasn’t alcohol, since that usually results in immediate charges. However, not all drunk driving accidents are so simple to investigate. For example, if a drunk driver causes a serious crash on their way home from a bar, investigators may want to dig into that bar’s actions to find out if they violated Texas liquor laws and over-served the driver. That could lead to consequences for both the alleged drunk driver and the negligent bar.
Of course, alcohol is just one possibility here. It’s important to make sure authorities are prioritizing evidence gathering so that all time-sensitive evidence can be preserved. Whatever ultimately happened here, getting the victim’s loved ones clear answers should be a priority.
