Commentary by Attorney Michael Grossman

Regardless of what happened here, people deserve to know that Texas has the most complex work fatality laws in the whole country. Despite what many believe, there isn’t always an automatic process for taking care of a worker’s family. Many families find they have to navigate a legal maze and contend with an uncooperative employer to just get answers, let alone a fair resolution that best meets their needs. In general, that’s why it’s important to approach a fatal work accident with the knowledge that OSHA alone isn’t likely going to take care of everything. In fact, even if they take months or over a year to complete their investigations, they might still just scratch the surface of what it will take for a family to see a proper conclusion.
