Commentary by Attorney Michael Grossman
Single-vehicle accidents often don’t receive the same level of scrutiny as multi-vehicle crashes, which can leave important questions unanswered. Investigators should take the time to examine road conditions, possible evasive maneuvers, and any environmental factors that could have contributed to the crash. Additionally, mechanical failures—such as brake malfunctions or steering issues—could explain why the vehicle left the road, and if seatbelts or airbags failed, injuries may have been worse than necessary. Authorities should also secure electronic evidence, including the vehicle’s Engine Control Module (ECM) data and any available GPS or surveillance footage. Ensuring a thorough investigation is the best way to get a clear picture of what really happened.
That all sounds obvious to say, but it would surprise folks how often victims and families come to me about crashes where authorities completely ignored these important factors or simply jumped to conclusions without consider extenuating potential circumstances. Sometimes, there needs to be a second set of eyes to catch these shortcomings, otherwise victims and families may be left with incomplete or inaccurate reports. It remains to be seen how thorough authorities were here.
