Commentary by Attorney Michael Grossman

When it comes to car accidents like this, a big misconception is that authorities are dedicating all of their resources to getting answers. Frankly, that’s usually not what happens. More often than not, departments feel they have higher priorities, so they fail to give officers the tools they need to investigate complex possible factors, and they’re rushed on to other jobs. That’s when things begin to slip through the cracks.

For example, I had a case recently where police blamed someone for not wearing their seatbelt. They figured that since the victim was thrown from their seat, they must not have been wearing it. Well, the family though that sounded very unlikely the victim, so they asked us to look into things. More thorough investigations revealed the victim’s seatbelt was defective, causing it to fail during the crash. He likely would have been okay had it not been for that defect.

While that sort of thing isn’t exactly common, it’s one of many things that accident reconstructionists should at least be able to rule out. Otherwise, victims and families can end up with more questions than answers during a time when they most deserve to have some closure. It remains to be seen if authorities here gave this accident the attention it needed./
