Commentary by Attorney Michael Grossman
With accidents like this, a lot of folks will immediately jump to conclusions. The unfortunate reality is people have a negative view of motorcyclists, so they just assume the victim did something wrong. Anytime I suggest alternative possible explanations for a crash crash, people are open-minded. Was there a vehicle defect? Did the road have missing signage or lighting? Did a tire blow out? But when folks hear the victim was on a motorcycle, any sense of open-mindedness flies out the window unless there is crystal clear evidence to tell the victim’s side of the story. That’s why it’s often best to ensure there are as thorough investigations as possible into crashes like this. Maybe authorities were able to get all the facts, but taking that for granted is a good way to leave gaps in the story.
