Commentary by Attorney Michael Grossman
Obviously, any suspicion of alcohol contributing to a crash is important either to confirm or to rule out. That’s not only to see accountability for a drunk driver, but it’s also to find out if there was a negligent alcohol provider involved, as well. If somewhere like a bar or liquor store unlawfully over-serves someone, they, too, can be held accountable for contributing to a resulting accident.
Despite handling hundreds of cases involving drunk drivers, I’ve rarely seen authorities take steps on their own to investigate negligent alcohol providers. That’s why I have to wonder if authorities ever handled these investigations properly, even if alcohol was indeed a factor.
