Commentary by Attorney Michael Grossman

I can only hope experienced investigators handled things and left no stone unturned. It would surprise folks how often authorities mishandle important investigations simply because single-vehicle wrecks aren’t seen as a high priority by a lot of departments. That can lead to false conclusions and half truths that only more thorough investigations can address.

Not long ago, for example, our firm was looking into a serious car crash. Something that stood out was police claiming that the victim hadn’t been wearing their seatbelt. The family never knew their loved one to forget something like that, so they wanted a second opinion. Well, more thorough independent accident reconstructions showed that the victim’s seatbelt was defective. They were wearing their seatbelt, but the pretensioner failed, and they were thrown from the car despite doing things right. Authorities simply jumped to conclusions because they thought the facts seemed clear at face value.

In situations like that, the truth usually only comes to light because a family is unsatisfied with the answers they’re getting (or not getting). Independent investigations can certainly confirm everything police already know, but it’s up to the evidence to speak for itself. I certainly hope authorities handling this crash either handled things properly or ensured the crash was in the hands of someone who would.
