Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured driver is receiving the medical care he needs and that investigators are working to uncover exactly why this incident occurred. A vehicle veering off a highway and striking a guardrail, especially in the early morning hours, can have many potential causes. While fatigue or distraction might seem like the most likely explanations, crashes like this often reveal more complexity on closer inspection. To truly understand what happened on Interstate 35, we need to ask three critical questions.
First, did the authorities thoroughly investigate the crash? When a vehicle departs a controlled-access roadway like I-35, investigators should examine not just where the crash occurred but how and why the vehicle left its lane. Was the road surface compromised due to weather, debris or poor maintenance? Were there any other vehicles nearby that may have caused the driver to swerve? Did the layout of the road, signage or lighting contribute to reduced driver awareness or delayed reaction? A detailed crash reconstruction is essential to determine whether this was a momentary lapse or if other factors were at play.
Second, has anyone considered whether a vehicle defect may have contributed to the crash? The 2014 Chevrolet Malibu involved should be inspected for mechanical or electronic failures that could have caused or worsened a loss of control. Issues with the steering system, braking components or electronic stability control can all cause a vehicle to behave unpredictably, especially at highway speeds. Tire condition and alignment should also be evaluated, as a blowout or imbalance could result in a sudden swerve. Unless the vehicle is preserved and examined, these potential causes may be missed entirely.
Finally, has all the electronic data related to the crash been collected? The Malibu is likely equipped with an engine control module capable of recording pre-crash data such as speed, throttle position, brake use and steering input. This information is invaluable in reconstructing what the driver was doing just before the crash and how the vehicle responded. If dashcam footage or nearby surveillance cameras are available, they may also provide visual context. Additionally, if the driver was using a GPS device or phone, that data could help establish the vehicle’s trajectory. This kind of evidence is time-sensitive and must be preserved early in the investigation.
Crashes like this deserve more than assumptions based on the time of day or the appearance of a single-vehicle incident. A man was seriously injured, and the circumstances leading up to that outcome must be fully explored. By asking the right questions, preserving physical and digital evidence, and considering all potential contributing factors, we can provide the clarity and accountability that the injured driver and his family deserve.
