There isn’t a lot of information confirmed right now, but a rear-end collision like this is rarely ever as straight-forward as people may believe. It’s important to know whether or not a reasonably prudent professional would have been able to avoid the collision. The circumstances could be such that the bus driver simply had no control over the situation, and it wouldn’t be right to blame someone for something they couldn’t avoid. But making that determination can take more in-depth investigations.

For example, I handled a case a while back involving a driver who was rear-ended by a semi-truck. The company claimed the victim’s vehicle slammed on its brakes and didn’t use a signal, so they couldn’t slow down in time. Through our investigations, though, we found a nearby security camera that caught the accident on video. In the video, the victim’s vehicle clearly slowed to a controlled stop, and the vehicle’s blinker was on. The approaching driver had several seconds to slow down safely, but they weren’t paying attention to the road, resulting in a serious accident.

I’m not suggesting that happened here, but there’s a tendency for folks to think authorities would be able to catch important pieces of evidence like that. In reality, officers don’t always have the time, equipment, or perhaps experience needed to conduct a thorough accident reconstruction. It’s possible independent investigations into this crash would only reassure the victim’s loved ones they’re getting the whole story. That alone can be a significant weight off their minds. But in the event there are important details not getting the attention they deserve, there have to be measures in place to see they’re brought to light.
