Commentary by Attorney Michael Grossman

If it’s true there was a drunk driver involved here, things might not be as open-and-shut as people may think. While authorities typically end their efforts once a drunk driver is facing charges, there could be more to the story. It’s important to know where the alcohol came from and whether or not a negligent alcohol provider over-served the driver. Let me explain.

In Texas, bars and other alcohol providers who over-serve people that are obviously intoxicated can be responsible when that intoxication leads to people getting hurt. The legal consequences these reckless establishments face can help not only to see accountability for a particular accident but also get them to clean up their act before their behaviors harms others.

Too often, though, these alcohol providers get to fly under the radar because all of the focus stays on the alleged drunk drivers. Ultimately, Texas law does not say that one wrongdoer or the other has to take the blame. Both drunk drivers and negligent alcohol providers can be held accountable for their role in accidents like this. That’s why it’s important to know what all investigators have looked into here and whether or not there are any accomplices who still need to be called out.
