People seeing charges recommended here might think everything is open-and-shut. When it comes to drunk driving accidents, though, the alleged drunk driver may just be the beginning.
If the allegations are true, where did the alcohol come from? In Texas, alcohol providers, such as bars, restaurants, or gas stations, can be responsible for an accident caused by someone whom they unlawfully over-served. In other words, if someone is obviously intoxicated and a clear danger to others, and an alcohol provider serves them anyway, the establishment can be responsible for resulting harm. As such, victims and families can see those providers held accountable for their role in a crash just as drunk drivers are held accountable for theirs.
What makes this challenging, though, is it’s not something authorities tend to pay attention to. I’ve handled hundreds of cases against negligent alcohol providers. I’ve seen how they clean up their act once they’re actually held accountable for their actions. But in most of those cases, authorities only stepped in after we independently investigated beyond the crash scene and brought the alcohol provider’s actions to light.
It’s possible authorities have been more thorough here and have determined where the driver got their alcohol from and whether it was served lawfully. In my experience, though, that shouldn’t be taken for granted. Following up with the authorities might show there’s still more to this story that needs to be addressed.
