Commentary by Attorney Michael Grossman
People often see pedestrian accidents and just assume everything will be straight-forward. Despite what many assume, though, pedestrian accidents aren’t always just about who had the right-of-way. Investigations should also take into account things like lighting, signage, road design, roadway conditions, alcohol, medical conditions, distractions, and any number of other possible extenuating circumstances. If something unusual happened, it needs to be brought to light. If not, a victim’s loved ones at least deserve to know they’re getting the whole story they deserve.
