Commentary by Attorney Michael Grossman

I’ve been handling Texas fatal work accident cases for more than 30 years now. I’m used to seeing OSHA reports which barely scratch the surface in terms of details surrounding an accident. It’s possible officials were more thorough behind the scenes to ensure the victim’s loved ones got clear answers. That’s just not the sort of thing anyone should ever take for granted.

At the end of the day, OSHA has their own priorities to worry about. That doesn’t necessarily align with getting answers for a worker’s loved ones, let alone helping them navigate the most complex fatal work accident laws in the whole country. That’s why I always caution people that there isn’t always a guarantee that a worker’s families will get the benefits or the resolution they deserve. It often falls to them to seek out those resolutions and ensure they have the evidence and tools needed to navigate the legal maze that is Texas work accident law.

The sooner those steps are taken, the better the chances there will be a proper resolution beyond just some administrative actions.
