Commentary by Attorney Michael Grossman
An accident like this may present more challenges than people may realize. For one, there’s the inherent challenge of investigating any fatal traffic accident. That has to include looking at things like vehicle speeds, possible distraction, road design, visibility conditions, right-of-way, etc.
On top of that, though, this incident could fall under the umbrella of a work fatality. Texas happens to have some of the most challenging work fatality laws of any other state in the country. That makes it crucial not only to find out what led to the accident but also what legal avenues may lie ahead for the victim’s loved ones. Gathering evidence is one thing, but knowing what evidence is actually needed is something else entirely.
