Fort Bend County, TX — October 31, 2025, Herbert Portillo was injured as the result of an 18-wheeler accident at around 9:14 p.m. on FM 723.
According to investigators, the accident took place north of Rosenberg off FM 723 and Kingdom Heights Boulevard.
Investigators said that 59-year-old Herbert Portillo was in a Toyota Highlander going northbound along FM 723. A tractor-trailer was going northbound, as well, when it reportedly failed to control speed. As a result, it collided with the Highlander and another vehicle.
Herbert Portillo reportedly was seriously injured. No other injuries were reported. Authorities recommended multiple charges against the truck driver. Additional details are unavailable.

With authorities saying that they’ve recommended multiple charges for the truck driver alleged to be at-fault here, this all may seem pretty open-and-shut. What folks don’t often consider, though, is the actions of a truck driver often aren’t made in a vacuum. It’s important investigations dig into whether or not a negligent employer’s actions also contributed to the crash.
I’ve handled hundreds of commercial vehicle accident cases. A lot of the time, there are problems going on behind the scenes that make an accident like this inevitable. Sometimes, employers push drivers to meet unreasonable deadlines, leading to rushed and reckless driving. They might demand drivers work long hours, leading to fatigued driving. A truck driver might not have proper qualifications, or they could be inexperienced and rushed through the hiring process. They might also have a history of reckless driving that an employer ignores because all they care about is getting trucks on the road.
When behavior like that leads to a serious wreck, consequences for the driver alone likely won’t solve the root issue that caused the crash. Accountability means ensuring all responsible parties face appropriate consequences for their actions so they clean up their act before more people get hurt. As investigations continue into this crash, evidence may show this all is down to a single reckless individual driver. Knowing for certain, though, means conducting thorough investigations which authorities might not be equipped to handle on their own.
