Commentary by Attorney Michael Grossman
With injuries this serious, I can’t help but wonder if authorities ever actually followed up with the victim. It’s a challenge folks don’t often consider, but authorities tend to rely a lot on statements from witnesses and drivers involved in a crash. Well, if there are no witnesses, and the driver is taken to the hospital and can’t speak to the investigating officer, where does the officer get their information?
Too often, the answer is they go with their gut, and that often leads to authorities blaming victims without actually knowing the whole story. Prudent officers, of course, will both follow up with the victim to get their side of the story and gather as much evidence as possible to fill in the blanks. But it would surprise folks to see how many victims and families call us about incomplete or inaccurate reports just because an officer couldn’t get a statement at the crash scene. Hopefully nothing like that happened here.
