Commentary by Attorney Michael Grossman

When people hear about a crash involving a large truck and multiple injuries, they often assume it’s a straightforward case of driver error. However, incidents like this head-on collision raise several questions that require thorough investigation to understand all the contributing factors.

First, we need to determine what caused the 18-wheeler to veer off the roadway and into oncoming traffic. Was the driver distracted, fatigued, or experiencing a medical emergency? It’s also possible that mechanical failure, such as brake issues or steering problems, played a role. Gathering data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements can provide crucial insights into these questions.

Next, the trucking company’s role must be scrutinized. Was the driver properly trained and adhering to safety protocols? Trucking companies have a duty to ensure their drivers are well-prepared for the challenges of the road. If the company neglected proper training or pushed the driver to meet unrealistic deadlines, they might share responsibility for the crash.

Additionally, examining the truck’s condition is vital. Was the vehicle properly maintained? Mechanical failures can significantly contribute to accidents, and reviewing maintenance records and conducting thorough inspections of the vehicle can reveal if such issues were a factor.

Investigations should go beyond the crash scene to uncover the full story. This includes looking into the truck driver’s logs, evaluating their driving history, and consulting with accident reconstruction experts. A comprehensive investigation ensures that all responsible parties are held accountable.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Whether through obtaining vital evidence or, if necessary, conducting an independent investigation, it’s crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
