Commentary by Attorney Michael Grossman
People tend to think drunk driving accidents are open-and-shut, but I’ve handled hundreds of alcohol-related accidents. They’re about as complex as it gets. It’s not just about having someone to blame. When alcohol is involved, it’s also important to know if there was an accomplice—a negligent alcohol provider.
Simply put, it’s unlawful in Texas for bars, restaurants, and other providers to serve someone who is obviously intoxicated. If they do so, and the leads to a serious accident, the alcohol provider can be responsible for their actions just like drunk drivers are responsible for theirs.
Too often, though, this slips through the cracks. Authorities tend to put all of their focus on those behind the wheel, so charging an alleged drunk driver may be the beginning and end of their investigations. Meanwhile, there could be a venue or store continuing to put the community in danger by over-serving people.
Accountability means ensuring that all wrongdoers are held responsible when their actions lead to a serious accident. If that was just a single reckless driver, then charges are certainly a big step forward. But if there’s evidence to show an outside party also broke the law and contributed to the crash, why should they get to ride off into the sunset while a family bears the burden for their mistakes? Texas law gives victims and families the opportunity to see that doesn’t happen.
