Hailey Heaton, 2 Injured in Alleged Drunk Driver Accident in Denison, TX

According to officials, 24-year-old Hailey Donell Heaton and a 25-year-old were in a Chevy Equinox on northbound Main Street. It appears a Toyota Tacoma also going northbound crashed into the back of their vehicle, forcing it off-road and into a pole. As a result, both Heaton and the passenger in the Chevy had reportedly serious injuries. The Tacoma driver reportedly had non-serious injuries.

Commentary by Attorney Michael Grossman

Authorities alleged in their statements that the Tacoma driver may have been under the influence of alcohol, and they recommended charges for intoxication assault. If that’s true, is an alleged intoxicated driver the only party responsible for the victims’ injuries? Folks might not think there would be anyone else to blame, but crashes like this often involve negligent alcohol providers.

Put simply, it’s illegal in Texas to over-serve someone who is obviously intoxication. Doing so makes an alcohol provider open to potential criminal investigations, fines, license suspensions, and liability for the resulting injuries. I’ve had hundreds of cases against those negligent alcohol providers, and it’s a vital path not just for getting people the help they need but also for cleaning up the act of an establishment that would likely otherwise continue putting lives at risk.

So as I read these details, if they’re true, then it obviously seems like there’s a driver here who needs to answer for their actions. But if they’re not the only one, I have to wonder if authorities have ensured the victims involved are getting the answered they need going forward.
