Commentary by Attorney Michael Grossman

I certainly won’t speculate about the circumstances surrounding this accident, but it’s important folks understand why just about any fatal work accident can be challenging for the victim’s loved ones. Put simply, work fatality law in Texas is more complex than in any other state in the country. This is due to the fact that employer’s are not required to subscribe to the workers’ comp system. As such, there isn’t always a guaranteed path for the families of workers killed on the job to get the benefits they need. That’s why it’s best steps are taken as soon as possible to find the legal avenue that applies to a given situation so the family can successfully navigate what often proves to be a legal maze.
