Irving, TX — August 29, 2024, Gilberto Duran Martinez was killed as the result of a workplace accident that happened off Hadrian Court.

According to initial details surrounding the accident, it happened along 1100 Hadrian Court, just off MacArthur Boulevard and Northgate Drive.

Investigators said that 51-year-old Gilberto Duran Martinez was in the area of an excavator at the time. Somehow, the excavator bucket struck Martinez. Martinez was fatally injured as a result.

There were no other reported injuries. The OSHA investigation summary lists two alleged citations. No further information is available right now.

While it isn’t clear how or why this incident occurred, it’s important that any work fatality in Texas gets thorough investigations early on. We have the most complex work fatality laws of any other state in the country. These laws sometimes result in families fighting for a fair resolution against employers who prioritize their own needs over those of their workers’ loved ones.

These legal hurdles can take significant evidence and strategizing to overcome, so waiting around for OSHA to complete an investigation isn’t always as prudent as seeking out investigators who can more efficiently gather the kind of evidence a family would need to tell their loved one’s side of the story.
