Commentary by Attorney Michael Grossman
People often overlook work accidents and assume there’s some automatic process for getting the victim’s loved ones the answer and the help they need. That’s not always how things go.
Texas has unique fatal work accident law which does not require employers to offer a guaranteed process of getting benefits for a family. On top of that, OSHA’s priority isn’t to get answers for the family; it’s to look for violations and issue fines.
This means families can be left with unanswered questions and no sort of help even months after losing a loved one to a work accident. There are of course paths to get them those things, but that almost always requires families seeking out those paths independently.
Hopefully steps have been taken here to look out for the needs of this worker’s family. I’d hate to hear that they were working with just as little information on this accident as the public is.
