Commentary by Attorney Michael Grossman

Frankly, even this early in the morning, there are few places drivers should be more cautious of potential pedestrians around them than outside of a gas station. People are there at all times of the day. Considering whether or not this truck driver should have been able to see and avoid the victim is going to be crucial for accident reconstructionists.

But the story may not be that straight-forward. Something people forget about is that the conditions on a given property may be less than ideal, making things more difficult for otherwise safe and attentive drivers. Was there ample lighting? Was the lot poorly designed such that pedestrians are unnecessarily put in danger of being hit by a vehicle? Have incidents like this happened before at this location, or were there ever complaints in the pass that weren’t addressed?

I can only hope authorities have been thorough in both regards to make sure nothing important slipped through the cracks. However this all could have been avoided, the victim’s loved ones deserve to know.
