Commentary by Attorney Michael Grossman

After an accident like this, it’s important not to jump to any conclusions before investigators can gather more facts. I know from decades of experience in my field that people don’t like missing parts in a story, so they sometimes fill in the blanks for themselves. In the case of single-vehicle crashes like this one, that too often means blaming the driver for making a mistake—being too tired, looking at a phone, being drunk, whatever flavor of error the accuser prefers.

While authorities can’t rule those out without further investigation, it’s important to keep an open mind and consider other potential explanations too. For example: Was the vehicle defective somehow? Did its airbags and seat belts work properly? What was the condition of the road? Was it well-lit at that time of night? How was the weather? Has anyone checked for electronic data, like phone records or the car’s Engine Control Module (ECM) information? Were there other extenuating factors the police investigations may have overlooked?

I’m not saying things have to be particularly complex in Crosby, only that in my experience they’re often less simple than a few sentences in the news might make someone believe. At the end of the day it’s important to ensure the whole story is learned, which takes diligence and patience. Otherwise something could slip through the cracks, and every effort should be made to prevent that.
