Commentary by Attorney Michael Grossman
Generally speaking, work accidents in Texas are already inherently challenging due to the fact there is not always a guaranteed path for workers to get benefits after an accident. Sometimes, they have to argue for a fair resolution if they feel their employer isn’t giving them a fair resolution on their own.
On top of that, though, there are a lot of details not clear right now about what happened. Did the trailer collapse due to a collision? Was there a preexisting issue with the trailer? Was the trailer overloaded? Was the victim on the forklift, or working nearby? This could be a complex series of events potentially even involving outside parties. That alone means a typical investigation into what happened here may only scratch the surface. Hopefully experienced and thorough investigators take the time to preserve as much evidence as possible here.
